Unfortunately, your landlord may not be very sympathetic to the fact that you’re having problems reaching things in your apartment. It is better to ask a friend or neighbor for help. As for the light bulbs, they fall under the category of “routine maintenance” which should be described in your lease. Look for the “lawn mowing and snow removal clause” as this usually accompanies other routine maintenance tasks. If you see the clause it means that you are responsible for changing light bulbs, replacing washers, etc. Even if this clause is in your lease, I would still consider asking for help when the landlord or maintenance worker is around the building. Hopefully he/she will understand that you are not trying to abuse the lease but rather just need a helping hand.

This seems like a tricky case but the best course of action is to be polite (very polite) and know what your options are. First, read your lease to determine what late fees apply. A landlord can only charge you a late fee if it is explicitly stated in the lease. However, seeing as you are breaking the lease by not paying your rent on time, it is in your best interest to pay a reasonable late fee if your landlord requests one. This will deter him/her from wanting to evict you. Write your landlord a letter explaining the circumstances and the date that you will pay the rent. Assure your landlord that this was an emergency situation and that it will not happen again in the future. You should also offer to pay whatever part you can immediately. Be sure you have the landlord’s permission to pay late in writing before sending a late check, as in most states a landlord can start the eviction process if rent is even one day late. In the future, I recommend getting an emergency-only credit card to be used for situations like this. Pay car or medical bills with credit and save cash for the rent.

Breaking a lease can be cumbersome because the burden is on you, not your landlord. Check your lease to see if subletting is allowed. This means you would have someone else living in the apartment but that you would still be responsible for it. This is not an ideal situation but it can work out if you get a responsible subletter. Another option is to assign the lease to a new renter. Assigning your lease means permanently transferring all the rights of the lease to a new renter for the remaining duration of the lease. You will usually have joint responsibility for damages to the apartment in this situation, so choose a renter wisely. Your landlord will have to approve the renter as well since a new lease will need to be signed. The last option is to actually break the lease. Explain the situation to your landlord and offer to help find a new renter. Doing this means you will likely lose your security deposit and have to keep paying rent until a new renter is found but at least you won’t end up in court. Expect your landlord to be upset and possibly give you a bad reference; this will vary with each landlord and how you present your situation.

I understand your anger but why are you taking responsibility for your roommate? Protect yourself by taking a dated photo of the damage and trying to secure proof that you were not there when the damage occurred (you could have your job confirm that you were out of town). Then firmly tell your roommate that he needs to report the damage to the landlord. If he refuses, call your landlord and expect to lose at least half your security deposit. If there is any money left, inform your roommate that his part of the security deposit has been lost and keep the rest. If your money has been depleted, consider this a lesson learned and be more discriminating when choosing a roommate in the future.

I’ve signed a years lease agreement.The building has been sold. When must I vacate?
One of my tenants recently decided to move out but his housemates are planning to stay. Do I need to have them sign a new lease? Can I just have them sign an addendum which states that the person who decided to move out is no longer on the lease?

my apartment was flooded from dirty, stagnant water from the roof for two months and the carpet was soaked through so much that when you stood on it, the brown water was up around your shoes. the landlord who knew about it was too cheap to fix it. after the flood, my apartment smelled very bad. for whom i need to report this kind of issue. thanks
If i received notice on the 10th that the rent will increase as of the new lease,the 1st of next month, am I still obligated to give a 30 day notice that I intend to move, due to the higher rent? Aren’t lanlords required to give more that a 2 week notice of increase?

Ever since we moved into our apartment, my husband and I have noticed a foul smell and my health has been deteriorating. Come to find out the apartment complex was flooded out about three years ago and the carpet was never replaced. There is a great deal of mold growing in our apartments underneath the carpet and in our air vents. We told the landlords about it and they said that they had checked it out (which was a lie) I am highly allergic to mold, which has been causing so many health problems for me. The landlords basically laughed at us and the note and told us that they would not replace anything because we have an animal in our apartment. They told us that we could leave once the lease was over (in July) We are not able to stay in our apartment because of the toxic mold. What are our legal options? Can we force them to replace the moldy carpets? What do we need to do to fix the problem? Thank you!

I am in a sticky situation. Me and my ex boyfriend (he is ex now) rented a home together back in December, He, myself, his son and my daughter all live here. Well, soon after moving in, our relationship began to unravel and we eventually decided to end our romantic relationship (well, he did anyway). Anyway, a huge contributing factor to the demise of our relationship was his ex girlfriend, who is also the mother of his 2 year old daughter. I found out eventually, that he was seeing her behind my back, and he decided to get back together with her.
Here is where it gets nasty. He told me that I WAS MOVING OUT ( I am on the lease) and he was moving his girlfriend and their daughter IN!!! I immediately objected as I am currently in no position to just go out and find a place to live, nor do I have the financial resources to do so. I informed the landlord of my exes intentions and he told me that he cannot just move someone in to the house without the new tenant going through the application process and credit check……..just like we did!!! He also told me that my ex cannot “give notice” for me, as by law, I have to give my own notice in writing.
I was considering kicking the ex and his son out of the house and finding a roommate, is there a way to go about this without going to court???

I would like to see more advertising for smoke free apartments. I have been living in my apartment for 2 yrs and my new neighbors smoke on occasion. The second hand smoke always drifts into my apartment. I did some research on the subject, however there are no rights for non-smokers living in apartments in WI (unless there is a specific clause in the lease). Unfortunately, non-smoking clauses uncommon in WI. It would be really great if there was more information on non-smoking apartments, how to find them, and states/cities that are being proactive about this issue. It really upsets me that my neighbors have the right to smoke in their apartment, but I DO NOT have the right to live in a smoke-free enviroment!

About 6 months ago a windstorm blew off my porch railings of my 2nd story apartment. The management has yet to fix the situation, and the caution tape that they had put up has also blown down during the 6 months. I was evicted from an apartment that was considered to be a health hazard to anyone that came in. I reported it to the health department prior to the notification of being evicted. My apartment complex is doing some renovations to all of the patios. All living areas are on the 2nd floor, so all patios are on the 2nd floor. A few weeks ago, I noticed they had started on a few patios by removing the guard rail that goes around them and replaced it by a 2 by 4. It’s been like that for weeks. They started on mine last week and they ripped off the guard rail and replaced it with a 2 by 4. They have done nothing with it so far this week. I have a 16 month old son who has been curiously crawling on furniture, unlocking doors and turning doorknobs. I also have a older daughter. I shutter at the thought that maybe one day my older daughter might leave the patio door unlocked or even slightly cracked and my baby finds it and curiously walks out on the patio and plummets to the concrete below. I have a sitter that stays with baby while at work. I constantly worry about this. My sitter is very competent and responsible, but I might even accidently not shut the door completely every single time. And my older daughter is forgetful. You would think that the apartment complex would be worried about a potential lawsuit if something should ever happen. I called today and spoke to someone about it. They could not give me any definites about how soon this will be taken care of. “We are hoping about 2 weeks” is all I got. What should I do?

I really need some advice. My Landlord’s Attorney sent me and my boyfriend a letter of eviction for non payment and gave us 14 days. I had told my landlord that my apartment got broke into & that we couldn’t pay for this month. I got an eviction notice for non payment of rent when I told my landlord that my apartment got broke into & my ATM card was taken along w/ money, etc. He said ok for me not paying this month but then hit my boyfriend in the head with a golf club when he was drunk on another occasion when my boyfriend confronted him about his girlfriend breaking into our house?!?! I have an autistic son who has recently(after the
new lease was signed) begun to open windows (even with safety locks) punch
through the screens and lean out of the window(we live on the third floor) I am

when i move into my apartments they offered secured gates at the doors. now that i have signed the lease they have taken the gates down. isn’t that breaking the contract.

My question is our appartment manager is trying to go back on some late fee’s they claim we have over 1 year ago. We never received notice of these fee’s until recent. $300.00 worth. My landlord and I verbally agreed to cancel my contract due to family issues. She verified with management and stated that management was ok and that I would only lose my deposit. (she had found another girl upstairs to move into my apartment). I agreed to it and moved out at the end of the month. Now I have a collection agency telling me I owe them future months of rent.

Theres a serious mold problem in my CA. rental. The landlord will get a person out to do a “mold test” whcih is taking a jar into the bathroom, getting air into jar and testing air in lab (?)
I’ve developed lethargy, headaches, lost my sense of taste and smell, can’t sleep well etc. How do I combat this? Who can test for this problem legitimately? What is my cost. Can I find out if landlord knew of mold problem prior to when I rented? Neighbors say 2 tennants in this unit before me, also had mold problrms. After signing a lease in November, without there being any mention of not smoking in the apartment Here it is December and we just had our landlord knock on our door and say we were not allowed to smoke in the apartment. We have been here six weeks, he has seen my husband smoke and said nothing for 6 weeks but now he is telling my husband he has to smoke outside. We have noticed that another tenant smokes and he and his family live in the back apartment. Is this enough to break the lease? This is the second command from the landlore that seems unreasonable and not in the lease.

I moved into an apartment in arkansas. Yesterday, I was one day late with the rent. I came out of the shower to find a police officer in my living room. He was placing on notice to evict on my counter. I think the officer is supposed to be an apartment agent, but he also signed the bottom of the notice as acting deputy. Is that legal? I know that he is a city police officer. The maintenence people also just walk in. I hear that Arkansas rental laws vary from different state laws. What rights do I have? And, can they serve me this notice after being one day late?

My boyfriend went to pay his rent and decided to pick up a brochure to look at other floor plans. In doing so, he discovered the exact same apartment he has, was being rented in the brochure for 757.00 a month,(this is not a special rate) his rent is 802.00 a month. He has been paying this amount for two years. We went to discuss this matter with the manager and she stated, although she did agree it was not fair, there was nothing she could do about it. I have been living in my apartment for about 6 months now and it has been so cold in here. I spoke with management and had someone out 3 different times to check the furnace.I have to keep the thermostat on 80 just to keep the temperature at 60, which causes my bill to be very high. My lease isnt up till the end of July. But my parents bought a new house and they will be moving in the new one by the end of april. They want me to move in their present house which they stay now. Generally not a problem. On your lease application there is usually an area to fill in other income or assets. Be prepared to show them a bank statement.

I was renting a house and I had to switch jobs to another state after I had been in the house for a year and 4 months. The contract stated that If I had to move out of state for work that I could get out of the contract. March 31st I faxed my 30 days notice in and called to make sure they got it. They guy I spoke with said he did. After I started my job my employer faxed employment proof. I called several times to make sure everything was done. My brother-n-law wrote a check for his rent. His bank emailed him to let him know it was returned. I let him borrow the money to replace right away with a money order a few days later. We went to the leasing office together and dropped it off. He returned the money back as he said he would the following week. Strange this is, he sent me an email saying that him and my sister were at the bank all day because they are still trying to get the rent from his account two weeks later. Is that legal?
Sondra, the answer is yes, you have the right, however you must be willing (and have the means) to wait out the fight it may take to return the money to your pocket. If your landlord is giving you troubles now, he will most likely be more upset when a bill arrives on his doorstep. If you are willing to fight in small claims court over the amount, and know that it could take even six months, a year or never for you to receive the reimbursement, you are able to pay for the repairs. The best thing would be to contact a lawyer to discuss more in depth the consequences your actions make take. The best of luck!
The landlord was part owner of the unit with her family now the court gave her full onwership of the property. we paid a depoist and now she wants another depoistof the same amount asing that is a law to receive at least 2 months of rent from the tenants, as well as increase the rent 6.5 percent because she is going back 1 year that the rent wasn’t raised yet she wasn’t the full owner. is this legal?

my manager just came around the apts. stating that the reginal manager said that the kids are not allowed outside to play. As an exsmoker myself,I can appreciate that you’d rather not live where there is smoke.However,the renter who is smoking INSIDE their own apt is well within their rights to do so.Smoking is restricted in so many public places that I think you should consider getting yourself an air filter for your comfort,and let the smoker have theirs.Smoke can be unpleasant…like someone’s bad perfume or body odor, yet,all people have rights.An easy way to avoid this is to only rent from landlords who restricted it from the beginning instead of hasseling the smokers who were allowed to move in.Live & let live

I am a renter in California. My lease says that guests cannot stay more than 12 days. My old parents are visiting from outside US and plan to stay for a few months. What should I do? As I see -
1. Declare this to my apt manager and sign a new lease with their names. Can he refuse to do this? Can he change the terms such as rent because its a brand new lease?
2. Do nothing. If he notices and asks for explanation, would I have any option? Technically I could be kicked out for lease violation.

Hi, My boyfriend and I are searching for our first apartment. I have run into some shady real estate agents and I’m not sure legally what is acceptable. I moved most of my stuff out about 2 weeks before the end of the lease but I didn’t turn my key’s in until the end of my lease. I couldn’t pay my last months rent because I lost my job (I notified the rental office). I recently moved out of my past apartment due to my husband’s deployment and just now got a bill from the apartment with charges. The one that alarms me most is rent base of 1406. I have no clue because I was told if they received the military orders there would be no rent charge. Plus the amount is weird because we paid 1240? So where did they number come from. my landlord refuses to place storm windows ever since we moved in. we have the heat on and still feel a draft. also, a hole in the wall from when someone broke in he wont fix either. and no smoke detectors. the water pressure is horrible and he says it’s because he doesnt want to pay too much for the water, but he has his own washer/dryer in the basement and we cant have our own. anytime we ask, he says he’ll get to it and never does. he charges us for using the parking space in the back but does not shovel the snow. who do i call if i live in medford, mass? please help me out here, before i lose it on him….thanks!

What is the general policy on apartment companies when you have not had renters history in 5-6 years. The deal is, me and a friend moved in with another friend of his when that person bought a house. No lease or contract, just rent a room. Do I need to put the house owner or just the last apartment I had(which Ill need to go dig for the info as I have totally forgotten.) Im hesitant to give his contact info as the house owner was more of my friends friend and he has long since moved, me and the house owner dont exactly get along and I dont know what he would say if called.I have great credit but no real recent rental.

In Florida, isn’t the security deposit supposed to be placed in an interest bearing account by the landlord? And then upon the end of the lease, assuming there’s no damage etc, the landlord owes the security deposit plus the interest back to the tenant within fourteen (14) days after the lease expires. Correct?
I paid my rent on on the 6th, which ia a day late on my lease. Now the complex part is I was got a letter saying I’ll be charged a fee on the late fee. I know a few people in real estate that own apartments, they say that it’s illegal. The cost will come to $62. I saw a PERFECT penthouse unit and was told that I was the first person to see it and that there were no other units available in the building. I asked for a $50 reduction in rent to bring it in line with other units in the area. Owners said they’d get back to me in the morning. I called first thing and they said they’d get back to me by 2pm. At 2pm, I got a call saying that at some point that morning, they had leased the unit to someone else for the full price. They said this person needed a large apt because they had a child and showed me another smaller unit for the same price. This sounds shady but what can I do?
I live in a illegal basement apartment that usually floods when it rains alot. Becuase of that the walls now have black mold and my landlord refuses to repair them. I also have an extra unwelcome tentant of the crawling variety and got an exterminating company to come in and clean the entire house and paid for 2 yrs for the service, my landlord wanted me to continue paying rent and the service. How do I get out of the lease without being taken to court? I have called the police on numerous occasions due to neighbors having late night parties and fighting and the landlord has not done anything about it. Is there something anyone can recommend for me to be able to break the lease?

My boyfriend and I currently live in a two bedroom duplex. He has been here for 6 years and has a good rental history here. His lease is up the end of August. My son is due to come home soon and the State of MI is requiring that my son has his own room. We occupy one room and boyfriend’s older son occupies the other room. Is there any way that he can legally break his lease? Does the fact that the State of Michigan is requiring three bedrooms before my son can come home, make any difference? Please Help!
i have a friend who’s roomate moved out in the middle of the month with little warning. luckily my friend was able to find a new roomate. the one that moved out is now demanding her part of the deposit and what ever the half of month she wasn’t there is worth. the big problem is that she’s asking the new roomate for the money! this doesn’t sound right to me but i’m not sure how to advise the new roomate. thanks for anyone’s help on this.

according to my lease my rent is due every month by the 4th but they are closed on Sat. and Sunday they have a sign posted outside that says they are open on those days with office hours and everything, i was late by one day because our mail man runs late on a friday and they were closed on sat. and sunday when i tried to take it up their so Monday they told me i have a late fee is that fair or even right is there anything that can be done about that?

During quaterly inspection, my new landlord noticed a hole in wall behind closet door and mini blinds taken down in small bedroom. I took blinds down because they were cheap and easily tangled up. She fixed everything and sent me bill. I thought it should be charged against my security deposit at move out.
I have had blinds replaced by old landlord and was not charged. The blinds are so cheap if you look out or pull them up a couple of times, they start to fall apart.

We recently moved out of our apartment of 7 years; our landlord refuses to give any of our $1250 deposit back claiming that because we smoked in the unit it had to sell it for $5000 less than he could have gotten. I recently began renting an apartment in a building in which there are four other apartments. My apartment however houses the boiler for the entire building’s heating system, as well as the control for the system. The boiler system is extremely loud, and keeps the apartment almost unbearably hot. I turned it off when I first moved in, not knowing it would effect the other apartments, and received a complaint form the property management I rent through the next day. This might be less of a problem, but none of the windows are capable of staying open on their own, and I have to inconveniently prop them open with blocks
My family has lived in an apt.(Playa Palms, Gilbert, AZ) for 2 years, our dog is on our lease. When we moved in, they weighed her in at 39 lb (the weight limit is 40) and said that would be the only weigh in. when our lease was up this September, we were told just to go month to month, so we have been paying the same amount and pet rent. This week we got a not saying we had 10 days to get rid of our dog, then a note saying they want to weigh her (she weigs 42.5 lb now) and if she’s not 40 lb she has to go. I had my adult son visiting as a guest and I notified my apartment complex of his stay. During his stay he had made friends with some other guest. He was invited by another renter to go to the club house to play pool.The following day I received a letter of unauthorized guest delivered to me by a police officer and informed me I violated the lease. we live in the first floor in the apartment building and we see lots of earwigs all over the place. Sometime we can see on the bathroom towels and twice in our bed which make us angree because in your sleep you do not know and get up from something moving on you. We told the apartment manager and it will take them forever to take care of it. What can we do?
I hope I can get an answer to my question here. A few months ago we got a letter saying from our apts that we got a “discount” from the total amount of our rent for paying on time every month. The next month we got another letter – turns out they made a mistake with the utility charges and the amount that was supposed to be a discount was what we had to pay for utilities and they made a mistake and not had not charged and so it came up as a “discount” and said we had to pay it. My question is it was their mistake can they still charge me for it even after we got that letter stating it was a “discount” for paying on time?

I rented from what I thought were decent people, however,that was not the case, the property was zoned to be only two apartments and the basement was for storage. When it was knowledge that it was not a legal unit, I contacted the landlord and they denied the alligation. Shortly after they took me to court and claimed I owed them $1500 for a unit that was not even zoned. They had two apts on the same meter and only one furnace and hot water heater for the whole building. Do I have any legal recourse in this matter.

been in a yr lease 4 2months. We moved frm another state n did wht i could online n on the phone. Whn i called this appt they tld me the details,1 of which was the util. is split btwn tenants n on avg are $60-$90, $90 being 4 winter. This lst month they were $177. I undrstnd they go up n down, but tht is a big difference. My husband n i wrk 40 hrs/wk n along side tht his pay dropped whn we moved, which was not expected. I moved into my a house for rent and my rent was pro-rated the 1st month. My lease is not under a management company it is strictly between my and the landlords. I gave a 45 day notice and said that I will be moving out on the 16th.I was told my rent was to be pro-rated. When I went to go pick up my letters from the landlord I was told that I would have to pay for the full month when told earlier in the week that it was to be pro-rated. Can they do that? My contract is for one year lease. I have my check that shows the move in $ cashed date on it. What do I need to do?

I was forced to sign a decrease in my rent and they said this apt. with burn holed carpete, siding above the carpet all torn with yucky glue to see, a black scratched bathroom sink, and the bedroom windows and taps are on backwords. I was even forced to pay $99 for a plumber when I called the maintenance manager to bring up her plunger but refused. Now they say you get NO Renovations and guess that included annual inspection as she did nothing. I have problems with my neighbours too who have mental illnesses with the dad in apt. next to them. I moved into an apartment with 2 roomates and signed a 13 month lease. I gave my landlord a 60 day notice that we were all moving out, Ohio requires a 30 days notice. The landlord called me to tell me he received my move out notice later that week. When we moved out and turned in our keys he called us and said he never got our move out notice and he would have to charge us for another months rent. When we moved in we were given a discounted rate of 659 from the usual 899. He said the market value for our last month was 899 and we had to pay that. We were never given a notice of the rent being raised. Can we fight this?

My ex-landlord took almost $300 for cleaning from my deposit despite me cleaning the apartment including the carpet(I paid for the carpet cleaning&steaming). My sister who was recently pregnant asked me for help a few weeks ago. A few days after I came to her apartment to get the house ready for the baby she was taken to the hospital. Even with being so close to delivery she lost the baby. That was 3 weeks ago. Since the new manag. has taken over our apartment complex, we have had nothing but problems. Our AC wasnt even coming on and my boyfriend called them on Friday. They finally come in Monday and left a paper that they fixed it, they didnt do a thing. We called every day after and Thursday they showed up and put an AC unit in. Finally Friday, our AC unit was fixed and they took the portable unit out. Now the portable unit is sitting right next to our door, since Friday! How long do they have in order to fix a problem with our apartment, before we can bring the lease agreement up and get out of this now apartment?

Our apartment complex rental office and maintenance is horrible. Our rental office have offered to renewal our lease with an increase. We have agreed. The maintenance man will take up to 4 days to fix an emergency. . The rental office has not finished the paperwork and our lease has ended, but they sent the rent bill with the increase. I have an odd situation and I need help determining if I can get my deposit and first months rent back.
I did sign a lease with the idea that I would clean the apt and he would fix everything that needed to be fixed. Period.
When I went in to clean discovered cockroaches. after going back and forth about getting rid if them, we decided not to move in. After a month he said he would have the apt professionally fumigated if I stayed, but if I didn’t he would just leave the problem for the next tennent.
In summary, he is refusing to give me back the deposit and 1st months rent since I signed the lease. Help?!?!?!

I now have a few dollars left which will probally pay rent for atleast one more month and my least renewal is due this month, I’ afraid to sign the least because I know that I can’t afford several months rent. The lease also states that I must give 2 months vacate notice,I can not afford rent for the next 2 months and also afford my moving cost .If I dont sign the least and remain on a month to month basis after the end of my least, I was told that I may do so for an additional $100.00 monthly plus, what I already pay, I can’t afford higher rent. I’ve been looking for apartments based on my income but all public housing has a waiting-list or the apartment sare not accepting applications. I do not want to become houseless. If I move without 60 notice I will be breaking the lease, If I pay the current rent due I want be able to move,If I sign the lease I will be comitting to many more months that I can’t afford, If I don’t sign the lease I will be required to pay additional $100.00 which I can not afford either.Management is aware of my situation.Why can’t I just move without 60 day notice,when that would be beneficial to both parties because it would save them the eviction process and cost to file and me the eviction and becoming homeless.
