I just moved into a new apartment and I share my yard with the residents of the two other floors in the building. I was sitting at the table in back when three terrifying dogs came running at me and I feared they were going to attack me. I was able to get away but I soon realized that this was going to be an ongoing issue when they came charging at me again as I was leaving for work in the morning. At night, they can bark for hours on end. I have confronted their owner but she said she has lived here for years and so have her dogs. The dogs weren’t around when I signed the lease and I wasn’t warned about them by my landlord. Is there anything I can do to at least get the dogs on a leash? Can I move out because of this?

Dear Attacked,

You can try to speak to your landlord but if the resident has lived there for years it is unlikely that you will get any help. Unless you are actually attacked by the dogs, you’re going to have a hard time moving out without breaking your lease and incurring fines for doing so. The next time the dogs are running loose, call your local animal control and report the issue. They can help determine if the dogs are dangerous and help convince the owner to keep them on a leash. Depending on the laws in your city, your neighbor could be fined for allowing the dogs to bark for long periods of time. There might even be a leash law that your neighbor is not following. When the dogs create problems again, call the police non-emergency number. If your neighbor gets a ticket for a noise violation, or failure to control the animals, it may inspire her to keep a closer eye on her dogs.

I am about to move across the city from one apartment to the other. In the past I have always been able to move in a day early since one lease usually ends on the last day of the month and the next lease starts on the first day of the month, leaving one night in between. This time, neither landlord is willing to compromise. My current landlord said that if I am not out by midnight on the last day of the month, I will be charged the rent for the next month. The new landlord said that I can’t move in until their office opens on the first. That means I have nowhere to put my things (or myself) for the night. Are the landlords allowed to do this?

Dear Stuck,

Unfortunately, this does happen to many renters. Landlords can give a “verbal agreement” stating that you’ll be able to stay an extra day in your old apartment or move in a day early to your new one and then might back out. If you don’t have anything in writing then there is very little you can do. You should try to be out by midnight, as it is legal in some states to charge you the next month’s rent or keep your security deposit if you don’t move out on time. I would suggest renting a truck to store your belongings overnight. If you need the help of movers, you can hire them to move your items into the truck on the 31st and then into your new place on the 1st. Find a hotel to stay in and relax—you deserve it.

I decided to renew my lease for a second year but I want to make a few changes. For one, I want my landlord to give my pet deposit back since I no longer have my dog (he’s with my boyfriend). I also think that the carpets should be cleaned as well as a few other routine maintenance things that would normally be done when a new resident moves in. Does the landlord need to take care of these things or can she pass the responsibility on to me?

Dear Renewing,

You have the option of “renewing” but this means you are keeping the same lease for another term. It sounds like you would prefer to sign a new lease in the same apartment. You do have the right to negotiate points in your lease but your landlord can refuse to re-sign your lease as well. If maintenance issues are not in the written lease, you have no legal right to require your landlord to fix anything other than those problems that are a health or safety concern. Negotiate what you want done and get it in writing before you sign a new lease.

One of the reasons I chose my apartment is because it has laundry facilities right next to my unit. But since I’ve moved in I’ve only been able to use the washer and dryer once because it’s always occupied. I tried to do laundry one night and even skipped my workout to start early. Even though I started at 7 p.m., I wasn’t done until midnight because I had to keep waiting for machines. I think this is unfair because the use of the facilities is included in my lease. Is there anything I can do?

Dear Waiting,

This is a very frustrating problem indeed. Your lease may guarantee you the right to use the laundry facilities but probably does not specify how much time you are guaranteed with the machines. Your best solution is to ask your landlord to post a laundry policy that specifies how may machines may be used and for how long. You may not be able to get everyone to comply but this will encourage some residents to be more courteous in the laundry room.

    I moved into an apartment very quickly and was not informed that dogs were not allowed… I notified them 4 days after I moved in that i had a dog and this was a problem.  Do i have any rights to get out of this lease without penalties?

    Unfortunately, it is your responsibility to read through your lease before you sign it exactly for this reason. Sadly, you probably don’t have any legal recourse, unless there’s a section in your lease that states you may break it within a certain period of time after move in. Take a look at your lease again and read it very carefully. Odds are, you’re going to have a very difficult decision, to keep your pet, or keep your lease.

    I moved into a beautifully landscaped place a few hundred cheaper than where I was living. It has taken a month to realize my unit has a unit underneath it that is infested with roaches. Of course, I am being affected. The site manager is working with me — but I am facing something major…I witnessed evidence and so these creatures are not going to evaporate…I signed a lease for a year…It’s been several days since I had a visit from pest control. Please advise my long-term actions and my legal rigts…

    Hi. As I know, read first, but I didn’t. I have just found out that my Landlord ends his leases on the 15th of the month. My new place is not open until the 1st. Now I am having to pay for storage for my stuff and an motel room until the 1st. Just a note to warn everyone to really read those leases! Whoda thought a lease could end in the middle of the month?!

    I’m living in an apartment complex that has an out of state water company. Well a lot of the residents are really behind on their bill (including myself). The water cannot be shut off because it is tied in together with other apartments in the same bldg. The management has now sent out notices that our rent money will be applied to our over due water bills. Is this legal, since tenants pay their rent on time, and now it’s going to be applied to the water and not rent. What happens if the money is taken and applied to the water, now the rent becomes deliquent. Please advise.

    I rented an apartment two months ago and signed a one year lease. Now I have lost my job and have no way to pay the rent. Is there any way I can get out of this lease? My landlord says no.

    I was living in an apartment in the Minneapolis area 7 months into a 13 month lease (one month free) when I got a new job in South Dakota. I tried working with my landlord to help getting it rented and my rent was paid up a month and a half in advance with the promise of being contacted if it would get rented or if not then I would be obligated to continue paying the rent. However I just received a bill for the remainder of my lease with penalties of my free month and other discounts saying that I am past due with my rent. Is this right or legal considering they have made no effort to contact me that the apartment has not been rented and since I now live over 4 hours away are they taking advantage of me since I can’t go and check to see if it rented or not? I am willing to pay for the rent due but feel it is unfair to penalize me considering I have made every effort to stay under the lease terms.

    I signed a lease for one year, but now I want to move out 3 months before. I did not find any terms about ending the lease early in my contract with the landlord, except I “should notify her one month before I move”. I am a co-tenant, the other two will not move out. Do you think I should paid any damage? If so, how much should I pay for?

  • A question about another matter. I was residing at the apartment for five years . in the middle of my lease the landlord sold the property. A landlord’s it took upon the property. Gave me a new lease. And my deposit from the first lease carried over. Doing a time as I resided at his apartment. I had several complaints and problems. About mold, water damage, leaky roof, an assortment of problems. Once I gave him the complaint. A week later he gave me a new lease. Raising the rent $100. Not fixing anything. A week later after that. The apartment as well as a whole building was condemned. And I was asked to move. I had 24-hour period , unless all my things in the apartment and I went to stay with my brother. I’ve been with my brother for more than six or seven months. And I still have not received my things to my apartment. My rent was paid and I was not behind. I did not receive my deposit back. As well all my things are a bad condition due to the situation.     I am currently living in a one bedroom apartment which is part of a large complex. I have lived there for several years. My fiancee and I are hoping to move in together in the next month or two. My dilemma is that I am worried that I will not be able to move out of my apartment without paying a large penalty. However, I never signed the lease that they sent me. My lease would have been from Sept. 2006 to Sept. 2007. However, in August 2006 there was a near-fatal attack in my apartment building, and after that happened the apartment complex did very little about it. I did actually make several attempts to contact the apartment manager to see what my options would be (month-to-month lease, paying a penalty, etc), since I knew I would be most likely wanting to move out. The manager never got back to me, and therefore I never signed the lease they had sent me. In my prior lease, it stated that if the lease was unsigned it would automatically renew for one year, but that managment would charge an extra fee per month, which they have not been charging me.
    Recently I spoke with the apartment manager; he stated that it didn’t matter that I never signed the lease and that I would have to give two months notice, and pay a two month penalty.

    Can you give me your opinion on this matter? Do I have a case for being on a month-to-month lease since I never signed one?

    I recently signed a new lease agreement on a new apartment I have been in over 16 months. The new agreement is set to start in April 2007. I am still under my old lease agreement as of Jan 2007. I just recently found out I could be transferred back to Louisiana. Is the new agreement my resposibility if I get transferred and still give 30-60-day notice on the lease I am under now?

    I am on a month to month lease with a roommate. I have chosen to move out, and have already moved. They have chosen to stay. “We” have both signed the paperwork to release me from the lease, but it is not valid until the roommate requalifies on their own. Therefore I am still on the lease and can’t get off. Recently the roommate has started using illegal substances in “our” apartment. I just want off the lease, and away from getting in trouble.     I want to move into a place of my own. I am 26 years old I have two kids and I just got married to my school sweetheart.We have been living in the house with his mother. We want to move out because it would be cheaper to just get a place of our own then try to help his mother fix everything.We can’t find any that will rent to us because we don’t have any credit or a co-signer.we have the money, and we can pay the rent,or

    I have a question. What are the landlords rights on entering you residence. Are they allowed to enter at anytime they feel? Or do they HAVE to notify you before they may enter at anytime?

    My daughter stored her belonging, furniture, dishes, clothes, Etc (including my 9 month old grandson’s crib!). at a friend’s apartment while she and my grandbaby lived in a homeless shelter for 6 weeks. Her friend was evicted, but was allowed to get only her things. My daughters’ things were not given back. She now has an apartment through the local housing authority, but can’t get her stuff back. The landlord told her when she asked him about it that he would burn it or give it away before she would get it back. What can she do? She can’t afford an attorney.

    I’ve been living in an apartment for 6 months I signed a lease for two years.  The landlord was sent to a nursing home and the property was sold.  The new owner is demanding more rent and a deposit is this legal?  Also he claims he can give us a 15 day notice to vacate even though he accepted our rent for this month… can he do this?  If my new landlord doesn’t accept my normal amount I’ve been paying all this time on the first of next month what is the eviction process.  I thought it was three day notice then seven days then 30 days.

    My boyfriend and I have lived in our current apartment for almost a year (the amount of time in my lease) and we have had several problems since living here. In the beginning we gave them plenty of notice that we were looking for a two bedroom townhouse by the beginning of March of last year. And our lease from our previous apartment was about to be up. We had to stay in our old apartment longer than expected and when the time came to move into our new apartment, they didn’t have the two bedroom townhouse available anymore. They offered us a three bedroom apartment for a hundred dollars off our rent. We thought that was a great deal so we took it. But since living here we have had several maintenance problems that have never been fixed. We have only 1 smoke alarm in this two story apartment and we have complained about it from day one. The tiles in our bath tub have fallen down and there is mold. Our sink has been clogged three times since living here and everytime we tell management to fix it, they never do and they threaten to charge us for fixing it. We have no weather stripping on our doors or windows and our electric bill keeps getting higher and higher. Again we have mentioned all of these things several times and nothing is ever done about it. We are so fed up that when our lease is up in March of this year we are going to find a way to move. Is there anything I can do to be compensated for any of these problems even though I am moving soon? And how can they rent to people with so many violations? There are apartments out here that have no carpet and one actually doesn’t even have a door to the oven!! How can they rent out apartments that are unsafe and how can I report these things before I move?

    I’ve lived at my residence for 2 years. I have 4 months left on the lease and i am fed up! 6 months into the lease the roof was leaking in my sons room so now is a huge hole in the ceiling…never been fixed.     I moved in a new apt. 6 months or so & I was not ask to sign a lease. I pay month to month. The 1 st. problem was trying to get my phone transfered to new apt. & they said they could not ,cause apt. was not regestered with the county for 911. So I looked into it on line & found on county or city search there is only 2 apts. regerstered at this address & there are really 4 in the building. 2nd. is I have been late paying rent maybe 2 times & she has charged me a late fee of 32.00 each time late,but when she want’s to be late picking rent she dont charge the late fee. The 3 rd. is she call’s everytime before she come’s to pick rent,but last time she did not & she intered my private gate knowing I have a small dog & my dog almost bit her & now she is mad . My husband that same day gave her rent & late fee & ask when you gona come fix some things in our apt.? She said she did not know & that she would let us know on next 1 st. of the month she might need us to move out to fix thing’s. This is not true , what need’s to be fixed is a light breaker in other apt. that controls our bathroom light . & 1 window screen. I really think she is wanting us to move ,cause she is mad about the dog thing.IMy util. are furnished with our rent, so when the breaker in front apt. shuts off we have no light in our bathroom & we have to ask the man in that apt. to plese turn it on so we can have light . What can or should I do?

    I’m 21 years old and I live with my mother and brother on the second floor apartment of a 3 floor apartment building. My ex-friend *Jane and her former boyfriend *Rob moved into the small one bedroom apartment on the third floor just before christmas. Anything to do with the apartment was signed over in Rob’s name. The young couple ended up getting into a fight and breaking up. Jane stayed with me for a couple weeks and Rob contacted the landlords letting them know about the situation and he then moved out and into a new apartment by himself. Meanwhile, the day that Rob moved out of the little third floor apartment Jane started staying back up there instead of with me…knowing that the landlords think that the apartment is vacant. The rent hasnt been paid for at least 3 months now and she is still living upstairs. Is this legal?

    I’ve been living in Cincinnati Ohio in Hamilton County in this apt since 2004. The building I live in are all 1-bedroom apts. Under Ohio Law I thought you had to have a seperate bedroom for all children over 18 months. Right now I know 2 apts in my bldg that has 1 adult/1 chid and 2 adults/1 child. These children are well over 18 months!! How do I find out what the law is and who do I call to report if this is a violation? Thanks!

    I’ve lived in this apt for 20 years. they sold the building and now the new landlord is trying to pay me to move out for a sum of money.Also my roommate that has lived here with me for 6 years they say he has to leave because is not on the lease. Do they have that right to do this? what should I do to solve this.

I have no family to help, I don’t want to end up in a roach infested dump. Medicaid says they can only pay for a nursing home, but they are awful and I really don’t need to be in one,what can I do?

    moved into a apt, 7/13/06 signed a year lease now the owner gave me less than 30 days to get out. it says upon the greater of 30 days notice required under the act, the landlord may terminate the tenancy under this lease without cause or reason. we have less than 30 days, how do you find another place to live on such so short notice? i would really like a response on this one because this puts me in a very difficult situation. is there anyway i can get a response on this matter?     My son recently was evicted from an apartment he had for only 2 months. It is his first apartment and he is being charged an additional $137.00 on top of not being refunded his damage deposit. My wife cosigned for the 6 month lease so we are responsible also. The charges are excessive and additional charges were added to the bill. Who can we contact to find out how to fight this.

    I was evicted in court and agreed to move cause I was devasted that someone
    had said they killed people on the 10 acres and there was drug activity. This came out to be false as I knew it would. I’m still living in motels cause I can’t get someplace decent.
    How can I over turn this. Am I in the right to ask for some compensation. The rental truck alone was over $600.

    I currently live in a 2BR apartment. My roommate is on the lease, but I am not. I informed him on March 15 that I would be moving out on April 1. I told him that I would help him in any way possible to find a new tenant to move in on April 1, and that if worst-case scenario we could not find someone for April 1, that I would pay all of April. I quickly sent him two leads for friends of mine who wanted to move in April 1. He instead chose a friend of his who couldn’t move in until April 15. What are my responsibilities? Do I owe him for the first two weeks of April? Do I owe him nothing since I offered him two tenants who could move in April 1? Do I have no responsibilities since I am not on the lease and since I signed nothing?

    My daughter and her children moved into a newly built apartment complex. She moved in, as soon as the building was ready. Her and the kids got very sick shortly after moving in, and are still sick, 7 months later. She noticed mold growing in the apt. She went to doctors asking them if mold could be the medical problem her and the kids were having. And they said no, since they were brand new apt. Also saying that we don’t have toxic mold in this area. She contacted HUD and they had came and tested the mold. The test results just came in. The results are that she lives in a toxic apt. The complex was told to clean it up in 1 month. Or my daughter and kids will have to move out. The complex manager told my daughter that they couldn’t get to it that soon. Because they were having the same problem in another city, and were installing new air ducts, and whatever else they had to do to fix the mold problem there. Now my daughter doesn’t know what to do. She can’t afford to move. Yet is scared to live there. One of my granddaughters has had her adnoids taken out and tubes put in her ears. Because the doctors thought that’s what needed to be done to get her better. She is still sick (of course) and now the doctor feels that, that she needs to be seen by an infectous disease doctor at Riley Hospital. My daughter just got the mold test results Saturday. The doctor hasn’t heard this news yet.
    The manager at the complex told my daughter that she is the only one there that got the test results. And being told that she may have to move out in 30 days. Because she is the only one that complained. Other people just moved out earlier. My daughter is a single parent of 3 girls, ages 8-2yrs old. What legal rights does she have. Does this expense of moving, all fall on her?

    I was evicted from my apartment and agreed to move, but I asked for a formal hearing to protest the eviction but I was never granted one. In stead I moved out. I can’t find anything reasonable because of Katrina’s destruction of so much property. Can I have this overturned so I might find affordable housing.

    I’m living in a multihousing apartment complex that is either tearing down the apartments or rehabing them not sure which. My lease isn’t up till October and out of all the apartments are vacant with only a handfull of tennants. I don’t feel safe here anymore. The building I live in has 8 apartments that are vacant. The building beside me has 4 apartments that are vacant. Then the other 5 buildings 40 apartments only have 4 occupants. They aren’t renewing anyones lease. I am on Section 8 housing and would like to know if it’s possible to get out of my lease since I don’t feel this is a safe enviorment. Someone was murdered a month ago in my complex don’t feel safe anymore.

    I recently was terminated from the apartment resident manager position I held from August 1, 2006 thru February 1, 2007. There was no apparent reasons for firing me other than the owner and the daughter were not enjoying how I decided that I did not have to remain on the phone with them while they were yelling at me and telling me how stupid I am. I have developed posotive relations with the current tenants still residing there and as my not being able to rent another apartment some of the tenatns as well as another proerty manager in a near by city have been more then helpful and let me stay some nights in their apartment so I could continue commuting from a 10 mile distance i was told that the employment and the tenancy termination and employment contract are one of the same as stipulated to in the form signed by both owner and myself. Does it matter if the processing agent on the owners LLC listing is out of date and conflicts with all contact information I have availavle in project file

    i live in ohio with a friend but she wants me out. I have been trying to get an apartment on my own but i get turned down because my employer has been cutting my hours. All the landlords tell him i can get an apartment if i had a co signer, but no one will co sign for me. Is there any advice some one could give me. Please help im afraid im going to be homeless soon.

    About 2 weeks ago my family and I found an apartment for rent. We liked the apartment but wanted a little time to think about it. A little later I went back and gave an application deposit. Since then , I’m sure others have gotten applications. It has been several days since I have heard from the landlady. Calls have been made to her with no answer, and no returned calls have we gotten. She lives about an hour away in another city. How do I handle this situation? In addition, the rent is due at my current residence.

    I need to know how to get an apartment out of state, without having a job in that particular state first. My boyfriend and I started filling out an application for an apartment, when the lady asked my boyfriend for his latest pay stub. Seeing as I currently reside and work in another state, she said that she was unable to take my credit into account, and that I would first have to have a job in the state I am planning on moving to, so that I can show her a current pay stub. How is this possible since I am going to be moving 2 and a half hours away?

    I recently just got a job about an hour away from which i live. I hate the drive but the job is worth it. Im am currently on lease untill january 2008 but was told if i wanted to move out early i would have to pay the remainder of the lease which is over 6,000 dollars, is there any way out of this, such as the neighbors above me have something wrong with their pipes, anytime they use hot water there is a very long and loud tapping noise throughout my apartment, i have complained about this many times to my apartment office, and the person that came out to fix it said the whole system needed replaced but the apartments were not going to get it fixed, could i use this to possibly get out of my lease?

    My sister and I have shared an apartment for 2 years. For the last year she has slacked on her portion of the rent and I have been left to cover. We are currently in the hole because she has made some empty promises, leaving me to scramble. Our lease is up in June and I am wondering how soon is too soon to begin looking (paying fees/putting down deposits) for a new place. Is it possible to be under 2 leases at the same time?     Hi, My name is Samantha.. My husband and I have recently moved into a new townhouse apartment. within 3 weeks we have had extreme amounts of problems. Our 2nd bedroom which is going to be our baby’s room has floor problems that the landlord says are fixed but nothing has changed about them. also one room in that bedroom won’t stay open. The sink in our upstairs bathroom leaks. There are about 5 steps that have no railing where if a child fell off it would be a 2-3 foot drop. Our kitchen window will not open,the sink we had to call them for the third time to come unclog it yesterday. The last time they came to unclog the kitchen sink I was not there but my husband said what they pulled out had live ants on it and since then we can’t get rid of them no matter what we do. We have french doors on our laundry room that will not close. Also we have a sliding glass door in our living room when it rains water soaks the floor all along it and about 1.5 ft out. They have lied to us repeatedly and once we caught them in the lie they admitted to it. Do we have a chance of getting out of this lease? I’m worried this place is not safe for my baby that we are expecting in June.

    I moved out of an apartment that is owned by one of the biggest apartment complex companies in Alaska.
    They kept all but 74 dollars of my 600 dollar deposit for a move out fee, carpet cleaning, and blind cleaning.
    The apartment was clean and I had just cleaned the blinds and carpets a few months before I moved out. I know that in the State of Alaska it is illegal for a landlord to charge for carpet and blind cleaning which I will be disputing, but can they keep more than half of the deposit for a moving out fee? I think that would be illegal also.
    I was told to contact the Attorney general about the practices of this company also.

It has now been almost seven months since I moved out of the apartment and I am having trouble getting the lanlord to return my deposit after the landlord stated that the apartment was in good condition and that she would be putting the deposit in the mail.     The complex we moved into showed us a model. we liked the model they showed us, however when we showed up to move in they placed us in a handicap apartment. they are unwilling to correct the problem immediately. they also state this is not their problem but ours. being a handicap aprtment it is completely unfunctional for us. is there any options for us.

    on Dec. 8, 2003 my tenants had giving me a security deposit for $1600.00 and sign a lease with me for 2 years at $800.00 per month,and was suppose to move in on Jan.2,2004 but moving things into the apartment before Jan. 2, 2004. However the lease was dated for them to move in on Jan. 2, 2004 – til Dec.31,2005, and so they did after they had brought their things over to my unit on and during the 2003 period.Now! 2004 comes around, they started to pay good but that would not last long.From Jan. 2,2004 – til June 5, 2004 they were paying good, but then on June 5, 2004 they pay me only $600.00 not the full $800.00 they oweded $200.00 towards Junes rent plus $59.00 for water. They told me that they would pay me the rest of the rent on June 10, 2004 but they never did. Now I ask you has the lease been broken, and if so can they still claim their security deposit? their least was not fulfill durning the 2004 – til 2005.

    3 years ago I lived in an apartment complex, me and my roommates had some issues, after speaking with management at the Complex they advised that I terminate my lease I was not evicted,
    I didn’t have to leave I just agreed to leave upon their recommendation, they broke the lease and I went my separate way, my last months rent I had written a check they held it for 3 weeks until they cashed it. The check bounced( I was in college very limited funds) the complex had always cashed my rent check a day or two later, then all of a sudden during this issue of me leaving the Complex holds my check for three weeks until they cash it. I feel this is unethical and that they did this on purpose the questions is, is there any legal action I can take, have they done anything illegal by holding a college students rent check for 3 weeks before cashing it, to this day I have not paid the Complex, because of what they did, I smell a rat do you, please help…

    I’m renting an apartment in tulsa, ok and I need to find out how their evitions are handled. My problem is this, Our landlord wants his rent on time (not to mention he has his brother and nephew running the property as well as him.) Anyhow, he doesn’t want to fix things in and around the apartments. I have been in my apt for 3months and I’ve tried to with hold rent for a few days to see if they will come and fix things but all he does is tape (pen or pencil) hand-written notes on the door giving me eviction threats for two months in a roll if rent isn’t paid on time. What do I do about the threats? And what is the proper way to file eviction or cause of eviction on a 6 months lease and how long does it take for the whole process in the stae of Oklahoma.

    i stay in a 1 bedroom apartment and i continuosly am having problems with water inside. going on three months now i have complained about mold and water in my carpet, it smells and they only come and paint the walss and vaccum up the water. i have a 2 year old son and this is causing him to have bad congestion. the other day on the 4th of june i noticed a spot of water on my ceiling which in an hour turned in to ma ceiling full, that night it bubbled up and started to leak. i complained they said wait until friday the 8th so i waited it got worse then it started to smell worse when they came all they did was paint over the wet area what should i do please help.

They found out that I need a new unit, they still have not put it in. They keep coming up with excuses like they can’t install it on weekends or it looks like it’s going to rain.     We have been having problems with our management giving us our lease renewal addendums in a timeframe that would allow us to give them 60 days notice we were going to move because we did not agree with the changes in our leases. This year, we had only 17 days to sign the addendum, or face eviction when our current lease lapses on July 31. We feel co hersed into signing the addendum because the addendum violates our original lease, that clearly states that management has to give us 120 days notice regarding the addendums and changes in our lease. We would have to give 60 days notice, pay the extra rent and extra charge

    my issue is i live in a apartment complex where it seems like every time you turn around the rent is going up. so know my rent is around 715 a month for a one bedroom. The complex just went under new mangagment and ever since it seems like these people are rude and do not know how to conduct business. anyway this month my rent is late and on my lease it states rent is due on the 1st but you have a 5 day grace period if it is not paid by the 6th of the month a $30per month charge will be added ok so why on the 13th of the month i get and eviction notice. don’t you have to give a person 30days to pay before and eviction notice.

    Yesterday,
    My wife and I returned to our apartment to find our 2,000 television missing. Upon police investigation, there was no signs of forced entry, and the only reasonable explanation is a maintenance or repair guy (hwo had came in last week to repair the air conditioner) set it up. Once the police report is complete I fully intend to sue the complex. Should I go Small Claims or hire an attorney?

    My sister is moving from an apartment into a house she just purchased. She’s been in her apartment approx. 6 years (a two family house). Water is included in her rent. She will be out July 31 but her landlord just put a letter under her door stating “The water bill has gone up since February and he expects her to pay the difference.” Is it just me or is that comical? Her rent has been paid and accepted through July. Is he just “hoping” she’ll be stupid enough to pay this. She’s afraid he will try to deduct it from her deposit.

    Where I live there is underground parking, and the pipes leak. Due to the rusted water leaking from the pipes, my paint on my car has been destroyed and I now have rust stains on my car. I’ve sent letters to the property management and still no response.

    I moved to Arizona to attend medical school and chose an apt for myself and my children that seemed safe at the time. We have been here about 2 mos and since then there was a murder just outside the pool area that was witnessed by a family with children. The family that witnessed this also said there was a sex offender in the complex that they (nor I ) were informed of when they moved in. Is this legal and for any of these incidents could I possibly have grounds to get out of my lease without great cost or damage to my credit?

    I have been caretaker of an apt bldg for 2 yrs. I was just fired as caretaker & was told that it was due to not fulfilling of all my duties. I know the true reason of this dismissal is much more personal. My problems began when I refused to decorate our bldg w/ x-mas ornaments since I dont celebrate that holiday. But she pressured me into doing it anyway. Since then I have been continuously treated unfairly. My lease is up next March, but she told me that I’ll have to either move out or start paying rent as of Sept 1st.

    renew or move. They told us we were too late, we must have been
    ‘overlooked’ in the lease end papers and we were legally bound to
    another month in that apartment.Eventually we found a few
    possibilities, but would need to show our apartment. When we went to do
    this, we discovered they had already rented out our apartment to someone
    else and never notified us! They claim that since they moved someone from that complex into our unit, we were still cover our unit’s rent- and they are covering their old unit. Can they do this? How can we still be held responsible?

    My daughter just moved out of an apartment she had been living in with a roommate for 2 years. She had a dog, she paid a non-refundable deposit for the pet of $250.00. After she moved out she got a letter from the manager that she had to pay over $800.00 for replacement of the carpet because of pet stains. My daughter was very clean and kept her apartment the same. Her roommate had a dog too and moved before her, she did not take care of the pet. I saw the apartment before she moved out, it was as clean as when she moved in. Nothing is on the lease or the pet lease about paying for replacing a carpet. What can we do?

    My lease is up 9/30. Before 6/30 I notified my landlord I’d be moving out in August. She snapped at me! “You have to pay through Sept” as if I was running out which I’m not. She does nothing about major problems. This place doesn’t even meet HUD inspections & she complains about paying pennies for decent outlet covers. Apt above me had plumbing problems which her unprofessional husband fixed & in process tore hole in my ceiling. Bath ceiling has mold issue too. Can’t afford a lawyer or inspector. I’m willing to cooperate but I want outta here. What to do so I get my Sec. Dep. back?

    2003 became ill due to hemmorage in lungs due to mold spores

    Realizing it may be my apartment for there is discoloration on the walls
    where they put in new windows
    a few years ago. Sometimes there is water aroung windows.
    I can smell mildew.

    Health department examined this
    I called NJ Community Affairs
    They called Landlord
    He said ok to fix the problem
    That was 3 days ago and I have
    not heard anything
    Can I withhold the rent? I should not have to pay to get sick Please advise my options.

    My one year lease was up in May. I have been paying month to month since then. I am now planning on vacating my apartment and have given the leasing office a 30 day notice. I submitted my notice on Aug. 16th and plan to vacate the apartment by Sept.15th. The leasing office is charging me the full amount of the rent for the month of September. They are not prorating my rent even though I’ve given them a 30 day notice and I’ve been month to month since May. Is this legal? Can they charge me for the entire month even though I will not live there and turn around and rent it to someone else as well?

    It is illegal to write invalid checks. You are always responsible to have the money in your checking account to cover any checks you may have written, even if they did do it on purpose. I don’t know of any law that states they have to cash your check within a certain time period. I am sure the complex has added this to your credit report and you will have problems renting elsewhere if you don’t clear up this misunderstanding. In addition they may give you a bad landlord reference. Based on what you wrote you are the only one that has done something illegal. Sorry…

    When I signed the lease, the apartment manager told me that they’re changing the utility system and renters will need to pay for water and gas eventually, however, probably not until 2008. Earlier this year (around Feb or March), I recieved a note saying I’ll need to pay for water and gas soon, but didnt’ specify when. I told the manager that I’ll be moving out next month, then all of a sudden, I received my first water bills (2 separate bills on the same day) for water usage back in April and May. Can they backcharge me like that? For usage almost half a year ago?

    I have a question regarding the lease. I have been renting an apartment from March 06. The first 1 yr lease completed this yr. I renewed it for 6 more months and it is supposed to finish this august 07. I got a renewal notice from my landlord in July with increase in rent for 7 month lease from September 07-Feb08. I signed it in end of July and returned it. I decided to move out in the first week of auugust 07 and let them know verbally on Aug7th 2007. Initially, the manager told me that I’m breaking my lease by signing to the agreement and that I should have given 30 day notice. I told them that I gave them close to 30 day notice. So she told me that I’m liable to pay 2 months rent as penalty and finally after talking 2 times, she told me she’ll just keep the security deposit as my penalty. I still feel that it is not right since its close 850$. I asked her if she can charge me for just1/2 month rent as penalty and take it from the security deposit. Also, my water bill has not come since I have occupied this apartment, but as of recently I received a notice on my door for a water bill upward of $200 and was told that the total amount is due with my next rental payment. Is that legal?

    I was trying to rent a condo from a man who wanted to meet me at a gas station to sign the lease. everything seemed fishy but i signed the lease anyway. he then asked me for the deposit (on a monday) but told me i wouldnt receive the keys until saturday. I never viewed the property because he kept telling me how bust he was and couldnt “keep” showing it to each individual.     Hello, our window unit broke two days ago (on Wednesday). We called the management office and they sent someone out on Thursday to tell us that this particular unit is already almost 9 years old and the compressor finally died so we need a new one.
    The management office apparently has been trying to find an apartment they lease that is empty to swap out window units, but they’re all too big. Its 2:30 and too late to have a hole cut in our wall big enough to fit one of the new ones.
    So now, we have to wait until Monday to get an air unit.
    Is this legal to make us wait this long when they could buy a new one?

    I signed a 13month lease and then had to breakt the lease 3months into it because of mold growing in my son’s walls (who was only 1!) and I was pregnant at the time as well. The apartment people did come out and “fix” the problem, only they didn’t and so I told them I was leaving. The manager said she didn’t blame me but now over a year later, we are being sued for the remainder of the lease. There were no property damages besides from their outter building leak that caused the mold and they did not have another apartment like the one we were in to move us into.   • I went to the landlord office to get a copy of my lease for 2007.

    The landlord refused to give me a copy of the lease and put a 3 day eviction notice on my door for false information for criminal conviction of a felony 3 months later in 2007.

    All felony charges where dismissed in 2003. I do not have any felony charges. I served 90 days for a misdemeanor (m1) that I completed in 2003.

    The Manager filed a Civil suit and evicted us without a forcible entry of detainer order. We did not get a trial. We did not get to talk to a judge. We don’t know what is going on.

    Does a manager need Court order to evict us?

    I lived in an apartment for 1 yr. Carpet was not new, it had to be stretched and cleaned before I moved in. It also was not tacked down on the edges, paint was around the edges to. Had a pat that was very sick, and did go in a area of another room, until I started keeping her in bathroom. They have replaced the carpet in the entire apartment and want me to pay for it. I admit, there was damage in the one area, but not 1200.00 worth. Am I entitled to proof of how much the carpet cost, how old the carpet was when I moved in, and proof that there was not a pet in the apt. before me?

    I moved into my Apt. around Aug. of 2007. In the first week the water got turned off and shortly after the electricity was shut off. My roommate could not afford either of the bills, so I ended up putting both in my name. Since then I have paid all of the electric and the majority of the water and have never been compensated for any of it. Now that we are in Jan. 2008 I’m having financial difficulties and the landlord
    called me this past Thursday and told me I had to be out immediately
    or he’ll put my belonging’s outside. I do owe him two month’s rent, so I know I owe him, but I was under the impression that regardless he was required to give me 31 days notice.
    The other problem is that even though I asked numerous times to be added to the lease it never happened. Can they just evict me or do they have to give me the time, and the landlord threatened to take me to court if I don’t get out.
    I am in a bad place right now and have no idea what to do, I don’t have enough money to move to another apt. and no prospects to move in even if I could afford it. I am really lost. Could you tell me what the real deal is. Thank you!

    While it is true that they can only spray with the residents permission. If it becomes an infestation then the management of your apartment is obligated to have the whole building tented. This means that the apartments will have to be vacant for to to three days, but it is well worth it.

    If you just signed the lease and have not moved in yet you should be able to cancel it. Most states have a 72 hour cancel time period.

    If the mold was black mold you have a court case because Black mold is very dangerous to your health. When you left the apartment community you should have received your deposit back. If it has been more than fourteen days since you moved out they now owe you twice the deoosit amount. Most states have a law that if yiour deposit is not refunded within fourteen then you are intitled to twice the amount. Check the law in your state and your doctor regarding the mold. If you are expierencing any health issues it could be contributed the the mold.

    I fell on the ice 2 days ago at my apt parking lot and am in major pain. Can’t drive, hard to breathe. I’ve seen my dr. and am on pain meds and have not been able to drive my car and today can’t go to work since the pain is now worse 2 days later.     I am being kicked out because I am making more then is allowed by section 42, I qualified once and it has only been 7 months since I qualified. I just renewed my lease and they are asking me to re-certify and told me if I don’t qualify I would be kicked out in 30 days.     I live in a month-to-month rental (no lease or agreement). I routinely have trouble with the neighbors above me (vandalism, theft, harrassment, etc) and try to avoid them. Unfortunately, they are related to one of the building’s owners. The landlord has told me that I am not allowed to call the police when they cause trouble.     What kind of rights do renters have to preserve the ability to live in peace? I’m a solid tenant of almost 7 years, pay my rent on time, and don’t disturb other tenants. The manager and his wife have a nasty habit of slamming the office door at all hours of the day and/or night.     All tenants received a letter yesterday stating the Fire Department “needs to be able to get into an apartment without having too many obstructions.” “If you or a family member cannot take the lock off, please contact the office to have them removed.”

    I have a sense of well-being because of this lock and use it every evening, as well as when my grandchildren stay with me. I usually don’t complain about things, but this disturbs me.

    I’m not a 100 percent sure but you an probably contact department of health and human services and they should be able to direct you as for what to do on the roach situation also the department of agriculture trade and consumer protection can help.

It’s spelled out on the lease and people always try to sneak them in. I have one couple removing a a dog and a cat. Not my problem. They signed a lease.

    My lease was not up until April the 15th. I paid my rent. I ask if I could move out on the 1st and paid for the 1 day first they said it was ok but then they turn around and told me that I had to paid up until the 15th. I told then I would paid until the 15th but I would not turn in the keys until then. I went to my mail but on the 3rd and they put a sign. Signing DO NOT PUT ANY MAIL IN THIS BOX VACANT. So I feel the termiated my lease on the 3rd even throught I paid until the 15th. That sign should have not been in by mailbox.

    I just found out today that an apartment we lived in reported on my credit/ background check that I was evicted. We moved within the same bldg from a 1 bedroom to a 2 bdrm when we found out that a baby was due. They state that I was evicted from the first unit, not the second.If we were evicted from one, how then did we move to another? I have both leases showing all move in/out dates. Also I got a nice letter from one of the leasing people after we moved from the 2nd one telling me if I needed anything to give her a call.They ruined my credit lied,forged my signature on a moveout checklist.How much can I sue for?

    My girlfriend and I looked at an apartment two weeks ago and fell in love. The property manager told us we could move in on the 15th of May – we applied and left a deposit check. The check was cashed immediatly and our application was approved.

    A different property manager from the same company called and said since the apartment was available may 1st, we had to move in then. I consulted with my girlfriend and we confirmed with the landlord that may 1st will do.

    It’s a week later. The landlord has not furnished a lease. They won’t return my calls. What gives? What do I do?

    Yes I had put in an application for a TwnHm that is not yet available till the end of the month- now the landlord said if I get approved I can put a holding deposit on it but I can’t look at it until after the current resident moves out, what are my rights with viewing the apartment before putting a hold on it and if I don’t like it can I get my holding deposit back?.. also how often are the carpets suppose to be changed and the appliances replaced?

    I’m in a situation right now with an apartment. My roommates and I signed and returned the application with the application fee and security deposit. They told us in the event we changed our minds, the security deposit is refundable. We receieved a phone call saying we’ve been approved, but no apartment was yet available for us. We DON’T want to live there anymore and returned to tell them and asked about our security deposit, which now they say is non-refundable, when initially they said it was. We didn’t sign a lease, contract, anything, and have no written documents of approval. how do we get it back?

    I’m trying to get back my security deposit after deciding I don’t want to live at this apartment. I only signed an application and turned in the required application fee and security deposit, which they initially told us was refundable. Now they’re saying its nonrefundable. However, we never received any written documentation of approval, never signed a lease or contract, nothing. So under the right of rescission I should be allowed to get my security deposit back. PA law allows 72 hours to cancel any legal contract without loss of monies. A lease is a contract, not an application. HELP!!!

    I’ve moved in this apartment as of 4/1/2008. The night of that day I heard the machine noisy all night with few minutes laps. Since then I’ve complained it to the management office twice. They said the noise comes out from the utility room which is next door of mine. Specially , during night time, I frequently wake up because of noise. I did even record the sound. Yesterday, I visited the magment office and realized the noise also is making when ever the elevator is working. Can you imagine how may times the elevator works a day and I have to hear the sound of it? Can I file the compained with IHA about this?

    I am at my wits end! I have a problem with maintenance coming into my apartment and taking very personal clothing. When I discovered it I requested in writing that I be notified to allow me to be present. This only made matters worse. Now maintenance has been harrassing me by sneeking in and leaving my freezer ajar, placing cigarette butt on floor, etc. There has been so many instances that if I was only half right in suspecting them it a wonder that I haven’t lost my mind.     you should have asked about a pet before moving in. If the company policy is a no pet policy & you don’t fall under any of the fair housing laws (RE: pets) than you must move at your expense or give the pet to someone else.

I don’t think this would happen, but if 2 people are on the lease,could each one just pay their half directly to whomever it’s payable and if it’s late pmt, then who would be nailed for late fee and reported to credit bureau?     I’ve lived at my apartment for almost a year this october. i had to find a new place because the area is just not the best. i have heard gun shots in the middle of tghe night and see drug deals going on in front of my face. my neighbors ask me for money and rides all the time. i am moving out of my place a month early because of this promblem. i can’t afford to pay rent in both places so my new place comes first. with this hurt my cerdit? and will they take me to court for the money for the last month rent?

Some other rats and mice were seen as well….and the landlord does not want to call exterminators…neither he covered the wholes (he promised) that are everywhere in the house and rats can come in every time.     I recently signed a lease for an apartment but the developer I am renting the apartment from has not yet signed the lease and returned a copy to me. I have not yet moved in but was anticipating moving in in two weeks. It has been over three weeks since I submitted the lease. Is there a time limit that the developer has to sign the lease within? Several weeks went by, and someone came by and said that they would be distributing checks on the next saturday, the saturday went by and not check.     I have been at my current apartment for going on 2 years now and haven’t had a problem until recently. A new tenant has moved in and has let it be known to my girlfriend and I that he enjoys hanging out on my downstairs neighbor’s patio because he can look up my girlfriend’s skirt as she walks down the stairs, and because at times he can hear us when we’re intimate. We have also caught him looking through our window several times, but never knocking on the door. I have notified the community manager who talked to him, but the problem still persists, making us very uncomfortable. Can we break the lease over this?

Well they replace me in another apartment temporary until they fix the problem which it took the next day to fix and they are trying to dry the rugs and have someone come out to wash the rugs.     I just moved from a unit in the same complex as the one I moved into (right downstairs). the landlord did a walk through and cleared for inspection. She had us hire her guy to clean the floors and we did. He cleaned them and she is not happy with the outcome (could not remove certain stains) we signed our new lease 4 days before the carpet was cleaned. Now she wants to charge us a third of the cost of the carpet which is $402. Are we expected to pay this? Please let me know!

The owners do not want the garage to be used for storage (a couple boxes), just for vehicles. Do they have a right to make this demand? If so, to what extent can they control how we choose to live?

    I live in Brooklyn in a three floor apartment. recently we got a new landlord and he seemed presentable and kind. i lived sharing a floor with my roomate who eventually moved. when the l/l came he said for me to move down into the basement because he was moving in on my floor. i didnt mind because i would have more space for myself. when i moved down and started paying my rent he said that renting basements was illegal and so i cant get any receipt. so far the basement is falling apart and leaking even though it was in good condition before and i dont know what to do next!

    My mother has lived in her rented home over 1 year. She renewed the lease 1/10. During the first year florida had a dry summer where we didn’t get a lot of rain. This year, it has rained more than last year. It appears that the house has a bad leak somewhere when it rains. 2 bedrooms are taking in water and we can not find the source.     I was on sublease name. But i stayed in apt.just for 5 months. A person who was staying there whose name is on lease left when i came here as he had to leavw within 1 week as his offc was moving and he was staying there from last 1 year. I moved out from that appartment as lease got over.
    So now lease office inspected the appartment after our moving out and sent a bill for amount $250.00 putting different damages charges. Last month mysteriously after the apt manager came to conduct an inspection my Ac went out. I called for a maintence man to come and fix it he did. They have not figured out the amount i owe clear back to January and i think its because they probably put my file to the side and forget about it. First question is how far back can they charge back pay? Second question how long do they have to configure an amount from the time you sign annual paperwork? Some ones help would be great. I called a lawyer and had to leave a voicemail. I cant find a number for renters advocacy in Alaska.

    Neighbor in next building from mine apt. she been living in this apt for about 15 years was told yesterday she has to move into a 1 bedroom apt. & she has less then 7 days to do it. My question is: How is a handicap woman supposed to move out in 7 days? If she doesn’t move out within the 7 days she will be evicted. The apt. she is in a townhouse upstairs and downstairs with full basement and her basement is filled with her belongings. Her kids are all grown that is why they told her she had to move into a 1 bedroom apt. Which I think they should wait until after Christmas!

    I was recalled to active duty and submitted notice to my apartment complex in VA early March 2011. My orders came down to the wire towards the last week of March stating that I had to report to WV. They advised that I would still have to pay for a month of rent which would be for April. I agree. However, they feel they need to see my dd214 because when i signed my lease I was not in the service anymore. I disagree with them needing it. I sent them my orders but they want the dd214. My old complex insists without it I would have to pay for 2 months rent. Please help.

When we moved in we were not told about the fact that they lease out to the Art Institute, so these apartments are used as dorms as well. After being here for a few months there has been all kinds of issues, trash being left every where, parties, things being broke, stuff being stolen (not our stuff), and the worst someone keeps urinating in our elevator and it happens on the weekend so since they don’t have anyone to clean it stays there till Monday. What rights if any do we have on this matter?

This is a bogus charge that I am fighting in court but just as well, it is still pending and shows up on a standard criminal background check. Is it simply impossible for me to find an apartmen under these circumstance? If I have my parents co-sign on the apartment, could I somehow bypass this? This is very frustrating because I have some nice places I would like to apply for but ofcourse don’t want to shell out the screening fee only to find out they can’t rent to me.     I signed a lease on 9/29/11 and on lease was effective 10/1/11. The landlord was renting the apts. before construction was even 75% complete. The apt was full of dust, 3 windows were broken and one with hole as large as bullet hole. I’m allergic to dust, dog & cat hair & many fibers. I started coughing in about 45 min. I told her I would have to break the lease because of the DUST & THE UNSAFE SURROUNDINGS WITH THE CONSTRUCTION, AS THE WINDOW WAS BROKEN BY A ROCK OR SOMETHING FROM CONSTRUCTION.
    DANGERS PLACE TO BE. THEY KEPT MY $265 dep for cleanup fee, I surrendered key 10/1/11. The kept my prepaid rent $645 also.

    Ok so we renewed our lease for 2 years, we have about a year left, we also just got pre-approved for a Morgage and found a house we love, we spoke to the landlord to let us break it early, and noticed that my lease agreement was written by hand and doesn’t have all the “fixings” of a legal document. is this still considered a binding contract? Mind you we didn’t get a copy of it until today when we realized we never got a copy back from the landlord. any advice would be great!

    Ive been at my apartment now for 6 months and since ive moved in my 3 year old daughter has been getting bit by fleas Ive complained numerous of times set my own flea bombs did this twice never had a pet. I have been transferred out of state for work and was notified of the transfer 5 days after the 60days was up. I am now legally supposed to pay for an extra month of rent because of this. I did not know what to expect after that from either her or her daughter, and feared staying there so I had my son agree to approve me signing off of the lease so that I could move. Does this issue entitle me to get my $700 damage deposit back or not? The landlord said I would have to get it from the son’s wife since she wrote the check for the deposit, but the manager at the time, requested the whole deposit be on one check!

    Management uses a master water meter for our complex and pays the water bill. Then they use a 3rd party to bill us for our portion of the bill. However, they are using this 3rd party to also bill us for a “trash fee” and “common area electricity fee.” After investigation, I found that management is only charging certain tenants for these fees (about $15 month). Is it legal for them to charge and add these fees in the middle of the lease as well as discriminate against who they choose to charge the fee to? Our lease says nothing at all about these fees.

There are people who have two to three people living with them. They divide the water bill between everyone who lives in that building. I have never complained about anything and have always fixed all small repairs myself. The apartment upstairs from me has become available and I would feel more secure living upstairs.     We have a very serious situation on our hands. We have a roommate who moved-in 2 weeks ago and he is now a “Lounger”. He has not made any payment since his move-in, which would’ve covered $80/day for maybe his first week. He has taken things from our kitchen that appear at times outside our house, and are still in his room, he has said he would pay on a certain date and that has passed.     I moved out of my old appartment in Sep 2011 and now its April 2012 and my apt company is contacting me regarding to pay for damages are they able to do that?

    My landlord sent a notice of entering my apartment through the mail, i didn’t check my mail, but it was there. it also stated that he would be entering all apartments but only entered mine and one other and left in a complex of 9 apartments. If he says he is entering all apartments and doesn’t is that against the law?

    i moved into a new apartment on May 14,2012. As of June 6, 2012 I still have no mailbox available. U.S. Postal service claims it is management’s responsibility to provide a postal box. At what point is legal advice needed to settle this matter? I require access to my mail, mandatory. (There was an old lock, no key, I had purchased a new lock with key and handed it the management for maintenance to install.) Thank you.

    I signed a year lease the start of Feb. Included in my rent is water and sewer/garbage fees. This months statement (for July) now shows the water fee at $20 higher then we signed on the lease, no prior notice to an increase either. Is this even legal?!

    JDN 1 – My tenant is basically on a verbal agreement. Everything was done based on trust and we started to develop somewhat of a friendship. It turned out that everything she put in email about herself ended up to be all lies. I asked her to leave and I woukd return the extra month paid as well as the deposit. We both agreed that she would leave on July 1st. She even put it in email to me. Based on this date, I got new tenants and signed a two year lease starting on the 1st as well. I told the new tenants that the current tenant has scheduled the walk thru at 7:00 pm on the 1st.

    JDN 2 – I told them that I would prorate the first day. It just happens that the existing tenant emailed me to say that the walk thru at 7:00 pm has to be rescheduled because her place is not ready and she will let me know when it will be. She is causing me major mental anguish and now I have to give the new tenants the option to get out of the lease based on the situation. Do I have any legal recours for this?

    My cable/internet is in a different name than what is on my lease, and is through a private company not the apartments. The other morning after an argument with landlord on not resigning my lease, they disconnected my cable/internet. The cable company came turned it back on and now I have a reconnect fee. Is any of this legal?

    I got a warning from the towing company at my apartment building that they would tow me in two days if I did not renew my registration. I am out of state so I asked for an extension which they gave me. When the extension was up I asked for 1 more week because in order to register my car in another state I need my Title which I am tracking down. They gave me the OK and said they would give me 1 more week and not tow me until 7/16/12. My car was towed this morning :( and I have not called the office yet or tried to get it out of towing. If I get a written confirmation of the extension can I force them to pay for the tow?

All my landlord tells me is I’ll put you down for the treatment they were suppose to come in yesterday and didn’t. My question is can I hold payment til this situation is resolved?

    I have many people who live in my apartment complex who are on disability and they are issued checks by the government. The checks are often not disbursed until the third of the month. Is there any protection against late rent fees when they are getting government assistance for disability? Thanks for your help.

    My landlord wants me to sign a lease after 10 years of living here. In the new lease it states that if I’m gone for more then 3 days I have to call and let her know. Is this something new that landlords are doing or is there something off about it?

    I just moved into my apt about 2 1/2 mos ago. I started seeing roaches with 2 to 3 days of being there. I notified the manager they had maintenance come out twice to spray. Now they are everywhere. I kill between 20 to 30 roaches a day. They are in my bed, fridge, bathrooms everywhere. Last night I killed 15 in my utility room. I have called mgt and sent them letters. I have taken pictures and had my state’s code enforcement come to my apt and he saw them first hand and also took pictures. He called and left mgt a voicemail and is sending a letter out to them on Monday. Can I get my money back? I’m not living there.

    My husband and I want to break a lease so we have a more suitable living space to take care of aging parents. Our current landlord is telling us we can break the lease but he’s asking for proof that my mother is coming to live with us. I can show him a plane ticket for her arrival but I want to make sure that’s it and that we’re not being harassed after we break the lease with him.     My tenant said she had ants in the apartment and thinks the came because tenant downstairs had moved. She also said she had left a cookie and it was all covered with ants. I told her I would send an exterminator. She said she left apt. for 2 weeks and now wants a refund for the 2 weeks. Do I have to pay her for that?

They want to start charging us for water but we have no meters and the way they are going to do this is just divde by the amount of people in each building by the amount that lives there. Is this legal? They said there going to go by the amount of people that live in the apartment themselfs what if there is a different amount of people that live in the builidngs then what they have on there leases in the office?     I have a serious question. I’m hard of hearing and my 4 years old daughter has down syndrome and she veey active. I been living this apartment for 1 year and 3 months. The property maintenance (he’s mexican) he always compl@ined my child running and making noises. He really making me feel guilty about my child can’t help herself as all other have kids inside this apartments complex. Do i have a right by law for her disability to file complaints against the apartment manager that she trying to make us move to another new apartments?

    I have been in an apartment that has offered FREE storage space from the very beginning of my lease. Management now wants to take that away and we were only given less then a months notice to clean out our the storage area. Is this legal?

    We live in an apartment complex in Wichita Kansas. We had a huige snow fall and the apartment complex did not clear the side walks or the parking lot. Our next snow fall thjey decided to clear everything. We complained about the first non removal of snow to the manager. The apartment complex stated that they were more liable if a person fell after they cleared the side walks and the parking lot? Versus not clearing everything. Have we been lied to by the management here? I really felt sorry for the elderly residents here. When the apartments chose not to clear the huge snow fall.

    Just a question for any one that may know. I have signed a new lease with a new leasing agent. This leasing agent was not working here in the time that I had signed on my new lease. The dates are completely wrong and I want to know would this be null and void. They want to charge me 500 dollars to break my lease. I have been looking for some legal advice.     I am moving out of my apartment on the 19th. On the 199th, the keys will be handed back to my landlord. However, she still wants me to pay utilities through the 31st of the month. If I gave her the keys, and therefore the house, how can I be responsible for the utilities? She could have someone move in and crank up the heat to 90, turn on all the lights, and run all the sinks 24/7 for all I know! Advise?

    Hello,I live in Philadelphia,Pa & my landlord owns 2 properties within a block radius of each other, one a 3 story apt bldg and the other a 2 story which he has owned for about 30 years and prior to that his aunt owned the house for at least another 30 yrs. Now all those years they were and have always been apts, evidently someone had made a complaint about a tenant that lived on the 1st fl in the 2 story bldg and now the city L&I stepped in and sited him for a zoning violation putting an orange paper on the property outside and also one in the window telling him that they arent zoned for apts. a that the 3 family dwelling(3 story 3 flrs apt blg) and 2 family dwelling (1st & 2nd fl apt) would have to be converted in both properties by removing a kitchen in each property (they said he needs to remove a stove & fridge from any fl in both bldgs ). Now when he tried to apply for a zoning permit for the 2 story bldg they denied him with the reason stating that the paticular block it resides on is not zoned for rental properties but yet across the street is a house that has apts for rent because I personally went to look at one when they had the 1st fl available so now my question is…..
    Wouldn’t this fall under the grandfather law since these properties have always been apts at least 40-50 yrs?
    He has went in front of the zoning board twice denying him a permit to keep the building as apts and now he is getting stressed, confused & disgusted in the whole situation, he is an older man early 70′s who is diabetic and physically not well so he just doesnt have the strength to continue this fight, and just up & sold the 3 story building which I have been renting a little over a year and is also selling the 2 story bldg that I used to rent 3 yrs prior to now , which leaves me up sh*ts creek without a paddle and have to find another place to live,,what are my rights as a tenant for almost 5 yrs with him not giving any prior warning with just leaving me out of a place to live. I only have less than 30 days to try and find another apt that I can afford in my area,but I was told that since the properties werent legally zoned to be apts that he would have to reimburse me for all the rent I paid since I lived here, is that true? I am now unemployed & looking for work so please help me find some solution to financially afford to move and not left lost on the street needing a place to live, thank you!

    I lived with a close friend & her family until a year ago, at which time I moved into a 1 bedroom apartment. It doesn’t have a lot of storage so she let me keep excess items (a room full) in an area above her garage (its been otherwise empty), I pay her $200.00 every month, we have had a disagreement & she is holding my things hostage as a way of control – I need to get to a few items, should I call the police & have them meet me there or what? Any advice is greatly appreciated.

    I rent my home and am in the process of getting my Home day care license. What I am wondering is if in my day care contracts I can put in it that the parent will not hold the landlord liable for any injuries to the child and if that would protect the landlord from being sued by parent? I of course will be caring the liability ins. for the day care.

    Does management all of a sudden have the right to tell you that your pet cant be over 25lbs and ask all personal questions if they have shots, who will take care of your pet if sometihng happens to you. How long you have a pet and the name of the vet, Also who has the key to your apartment to get in if something happens. Also if your pet has fleas mites or heartworm and if the pet is shy,aggressive, friendly,and gentle. Is this going a little to far. What about the tenants privacy who are they to ask who will take care of your pet and where do they live.

    We have been living with a strong odor in 2 areas of our apartment for about 2 months. We have worked with management to try to find and resolve the source. So far there is no evidence of any source for the odors and they seem to me to be possibly chemical and in the walls or ceiling. Management has agreed to move us to a new unit, but only if we sign a settlement agreement alleviating everyone of liability in the event we have health problems from these odors. They have refused any re-wording and will only move us under these terms. If we sign and then did have health problems, is this enforceable? Are they in Breech of Contract? Do they have an obligation to provide us with safe and adequate housing?

    My daughter moved into an apartment 2 months ago and they knew she had two dogs and what they were border collie mix and a boxer mix. A tenant complained that she had a pit bull. She has been told that she needs to prove it’s not a pit bull or get rid of her. She has been told that the person that complained had a pit bull last year and had to get rid of it so now is after anyone. She might be mixed with pit so her vet doesn’t want to put his name on something saying that she is not in case something happens. Does she have any rights? Or is there something that she can do?
